Welcome to KidsPlaySpace. These Terms of Service (“Terms”) govern your access to and use of the KidsPlaySpace website at kidsplayspace.com.au and all related services (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Service.

1. Eligibility and Accounts

You must be at least 18 years of age to create an account or use the Service. By creating an account, you represent and warrant that you are at least 18 years old and that all information you provide is accurate, current, and complete. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

We reserve the right to suspend or terminate your account at any time if we reasonably believe you have violated these Terms or engaged in fraudulent or harmful activity.

2. Venue Listings

Venue owners may submit listings for their businesses through our platform. By submitting a listing, you represent that you are authorised to do so and that all information provided is accurate and not misleading. We reserve the right to review, edit, or remove any listing that violates these Terms, contains inaccurate information, or is deemed inappropriate.

Free and paid listing tiers are available. Paid listings provide additional features as described on our Pricing page. Fees for paid listings are non-refundable unless otherwise stated. Recurring subscriptions may be cancelled at any time, with access continuing until the end of the current billing period.

3. User Reviews and Content

Users may submit reviews, ratings, photos, and other content (“User Content”). By submitting User Content, you grant KidsPlaySpace a non-exclusive, royalty-free, worldwide licence to use, display, reproduce, and distribute your User Content in connection with the Service.

You agree that your User Content will not contain material that is defamatory, obscene, abusive, discriminatory, or otherwise unlawful. We reserve the right to moderate, edit, or remove User Content at our discretion. Reviews must be based on genuine personal experiences. Fake or incentivised reviews are prohibited.

4. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws, regulations, or third-party rights
• Submit false, misleading, or fraudulent information
• Impersonate any person or entity
• Interfere with or disrupt the Service or its infrastructure
• Scrape, crawl, or collect data from the Service without our written permission
• Use automated systems or bots to access the Service
• Transmit viruses, malware, or other harmful code
• Harass, abuse, or threaten other users

5. Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are owned by KidsPlaySpace and are protected by Australian and international copyright, trademark, and other intellectual property laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent. You retain ownership of any User Content you submit, subject to the licence granted above.

6. Third-Party Links and Services

The Service may contain links to third-party websites or services that are not owned or controlled by KidsPlaySpace. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that KidsPlaySpace shall not be responsible or liable for any damage or loss caused by your use of any such third-party content or services.

7. Disclaimer of Warranties

The Service is provided on an “as is” and “as available” basis, without any warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or secure. We do not verify or endorse any venue listed on the platform, and we make no representations about the quality, safety, or suitability of any venue. You visit venues at your own risk and should exercise your own judgement.

8. Limitation of Liability

To the maximum extent permitted by Australian law, KidsPlaySpace and its directors, employees, partners, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or in connection with your use of the Service, whether based on warranty, contract, tort, or any other legal theory.

9. Indemnification

You agree to indemnify, defend, and hold harmless KidsPlaySpace and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or related to your use of the Service, your User Content, or your violation of these Terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of New South Wales, Australia, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of New South Wales.

11. Changes to These Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. Your continued use of the Service after any changes constitutes acceptance of the new Terms.
